Abuja — A Federal High Court sitting in Abuja yesterday granted leave to former military President, General Ibrahim Babangida, to apply for an order seeking to quash the report of the Human Rights Violations Investigations Commission (HRVIC) presented to the Federal Government on May 28, this year.

Justice Binta Murtala Nyako, hearing the suit, however, adjourned till November 12, and directed that all other reliefs sought would be taken along with the substantive matter.

Joined in the suit are the Attorney-General of the Federation (AGF) and the Inspector General of Police (IGP) and HRVIC .

On October 10, 2002 Babangida and his former Security Chief, Brigadier-General Halilu Akilu (rtd.) went to court seeking for leave to apply for an order quashing the HRVIC report.

The plaintiffs were interested in the portion, which linked them with the killing of the founding Editor-in-Chief of Newswatch magazine, Mr. Dele Giwa. Giwa was assassinated on October 19, 1986 through a parcel bomb.

Moving the motion yesterday, counsel to the plaintiffs Mr Yahaya Mahmoud who appeared with Dr. (Col.) Bello Fadile said by virtue of paragraph 4(g) of the affidavit in support of the motion on notice deposed to Fadile, the force CID had completed investigations into the matter and that the culprits were identified.
