Ghana: Importers of Foreign Drugs Without Labelling in English to Be Sanctioned

Deputy Chief Executive in charge of drugs of the food and drugs board, Mr. B.K Botwe has stated that the Ghana labeling regulation, LI 1541 requires that all products coming into the country must be labeled in English or have an English translation thereof if the labeling is in another language.

He added that the board does not permit official importation of products that are not labeled in English but however noted that some persons may carry some amounts of such improperly labeled products either in their hand luggage or have them smuggled into the country.

These non-conformances he said occur in all jurisdictions but they would ensure that the situation does not become overwhelming.

Mr. Botwe said this in response to questions by the chronicle on what the board was doing about the importation of foreign drugs with prescriptions in other languages into the country.

He mentioned that the board has port offices at the airport and Tema harbour that do physical inspections of products imported in commercial quantities to ensure proper labeling among others. Additionally, import permits are issued for all official commercial drug imports.

Asked what the board would do to importers who would not abide by the rules of the board to this effect the deputy chief executive said if any such complaint about improperly labeled products is made by members of the public or detected by the boards post market surveillance unit, a disclaimer may be issued in the press warning the public about the purchase and use of that specific product or a product recall may be ordered. Verified and recalled products are then destroyed as appropriate.

He noted that depending on the severity of the matter it could be referred to the police for further action and possible prosecution.

He assured the general public that the board will take appropriate regulator sanctions against any persons or company that does not follow the laid down rules for importation and labeling as provided for under the food and drugs law PNDC Law 3095B of 19992 as amended by food and drugs amended act 523 of 1996 and LII 541.

The importation of foreign drugs into the country makes it difficult for consumers at times. Some of these drugs have their prescriptions in other languages. If consumers want to use it they have to get experts to interpret it into the English language or other languages.
