Zambia: Attorney General to Substitute Mark Chona

PARTIES involved in a case in which Second Republican President Frederick Chiluba is challenging the seizure of his goods have agreed that former Task Force on Corruption chairperson, Mark Chona, should be substituted with the Attorney General George Kunda, as the defendant.

According to consent order dated March 9, this year before Lusaka High Court Judge Naboth Mwanza, the parties agreed to substitute Mr Chona with Mr Kunda and to set aside the default judgment, which was delivered against the former Task Force chief.

This is in a case in which, Dr Chiluba had sued Mr Chona for seizing his 21 trunks and 11 suitcases and damages for interference with his personal things and costs.

He had claimed that Mr Chona on March 11, 2005 had unlawfully and without informing him taken possession of his personal effects stored at Access Financial Services (AFS) warehouse.

The parties further consented that committal proceedings issued against Mr Chona be withdrawn and that Dr Chiluba was at liberty to amend all pleadings issued against the former Task Force chairperson.

Mr Kunda was at liberty to file his defence, if any, within 14 days from the date of receipt of the amended statement of claim.

Among other things that Dr Chiluba was claiming are, 150 suits, 300 shirts, 50 pairs of shoes and photo albums with pictures of himself and the late Pope John Paul 11.

Other items included books and his children's birth records and money ranging between K2 and K10 million

The matter comes up on March 23 for hearing and determination.
