Nairobi — Mr James Kamangu, the alleged former husband of Jesus is Alive Ministries Bishop Margaret Wanjiru, will not be cross-examined after all, a court has ruled.
Wanjiru lost yet another round in her battle with Kamangu, when the courts threw out her request to have the man cross-examined on Thursday.
The ban on her planned wedding to a South African preacher, Mr Samuel Matjeke was also extended by the High Court until the case is heard and determined. Wanjiru had her plans interrupted last weekend by an earlier order obtained by Kamangu, to stop the wedding.
She was told to limit herself to what has been raised in the affidavits filed in court by Kamangu.
"The court will not allow the defendant (Wanjiru) to rove in search of matters not relevant to the case," said Justice George Dulu.
Even though Wanjiru's lawyers argued that the cross-examination would give Kamangu a chance to tell it all, the court thought otherwise. Saying that the cross-examination was not in the interest of justice, the judge said, "the application by the defendant does not succeed and I hereby dismiss it."
He said if he allowed the request to have Kamangu questioned, there was a danger that the "court could be trapped into handling issues that would have been dealt with at a full hearing."
In his affidavit, Kamangu had said that he married Wanjiru between 1978-1979/1980. Ojiambo had told the court that it was crucial for Kamangu to tell the court the exact date he married his client.
The case will be mentioned next Tuesday.
