Zimbabwe: Mann to Appeal

25 July 2007

Harare — THE High Court will tomorrow hear an appeal by British mercenary Simon Francis Mann against a magistrate's ruling to have him extradited to Equatorial Guinea to face charges of plotting a coup.

Mann completed his four-year jail term for breaching Zimbabwean firearms and immigration laws on May 9, but remained in custody pending his extradition to face trial for allegedly masterminding a coup to overthrow the

government of President Teodoro Obiang Mbasogo Nguema.

His bid for bail pending the appeal failed after the trial court dismissed the application.

Mann, who is currently held at Chikurubi Maximum Security Prison on an immigration detention warrant, will be contesting the magistrate's decision through his lawyer Mr Jonathan Samkange of Byron Venturas and Partners.

In his notice of appeal, Mann wants the court to nullify his extradition to Equatorial Guinea and grant an order to have him released from jail and deported to England.

Mr Samkange will argue that the trial magistrate did not consider credible evidence given by his client during the hearing. He will further argue that the magistrate failed to show how and why she arrived at her decision.
