Nairobi — The High Court registry has been ordered to supply Mr Tom Cholmondeley with a record of appeal to process his case.
Issuing the orders on Friday, Justice Muga Apondi observed that it was unfortunate for Lord Delamere's grandson not to have received the document.
"The delay is not reasonable and I order the Principal Deputy Registrar, Mrs M Wamae to supply the defence with the record of appeal," the judge said.
Wamae was also ordered to supply Cholmondeley with a notice of appeal, to process application challenging the High Court's decision requiring him to furnish the prosecution with witness statements.
Wamae was asked to comply within seven days.
The orders were issued after Cholmondeley informed the court, through his advocate, Mr James Muthui, that the High Court registry has not prepared the notice of appeal as the law requires.
The defence told the court that it wrote to Wamae to furnish it with proceedings from May 24 last year to July 25; immediately it was ruled Cholmondeley had a case to answer.
The 38 year-old-rancher, who denied murdering stonemason, the late Robert Njoya at the Soysambu farm, opted to move to Court of Appeal following the High Court's decision requiring him to supply the prosecution with witness statements.
