Nigeria: Doctor Suspended Over Death of Patient

The Medical Practitioners Investigative Tribunal sitting in Lagos, yesterday withdrew the Practicing licence of a medical doctor, (names withheld), for causing the death of one of his patient, Mrs Florence Abatan in 2004, following a surgery operation, which led to her bleeding to death.
Another doctor, was suspended for six months, while Tarek Fom- Dom, warned by the same tribunal. The two other doctors took part in the said operation of late Florence Abatan.
According to the Tribunal, the trio was said to have carried out a surgery operation on Mrs Abatan at Maitama District Hospital, Abuja, in a negligent manner.
Mrs Abatan was said to had declined blood transfusion on the ground that she was a Jehovah witness, unfortunately, Adebayo and colleagues failed to device alternative line of management even though the patient had suffered severe blood loss during the surgery .
But the suspended doctor was accused of allowing his less qualified and experienced colleagues to perform the surgery on the patient and thus exposed her to the higher risk of blood loss.
Handing down the judgement, the Chairman of the Tribunal, Dr. Shima Gyoh declared that Dr. Adebayo is guilty of the charges.
"For negligence of duty, uncaring altitude and incompetence to carry out the surgery on such high- risk patient, Adebayo's practicing licence was withdrawn for 12 months after which he can re-apply.
The Tribunal also frowned at Adebayo and his subordinates' failure to document the fact of refusal blood transfusion or device alternative line of management even though the patient had suffered severe blood loss during the surgery .

The Tribunal however declared that he (Dr. Adebayo ) has conducted himself infamously in a professional respect contrary to Rule 28 of the Code of Medical Ethics in Nigeria (2004 edition) and punishable under section 16 of the Medical and Dental Practitioners Act CAP. M8 Laws of the Federation of Nigeria 2004.
Continuing with the Judgement, Dr. Godit Z Millam who was suspended was accused of undertaking surgeries of a caesarian section and bilateral tubal legation on same Mrs. Abatan when there was no clear indication for the surgery of bilateral Tubal ligation.
Dr. Millam was also accused of not ensuring that blood was ready for transfusion and also that the patient was disposed to accept blood transfusion, if necessary.
