Kenya: Anti-Terror Unit Boss in Court

Anti-terrorism police unit boss Nicholas Kamwende yesterday took to the dock after he was summoned to explain the whereabouts of three suspects arrested in July.

Mr Kamwende told Mr Justice George Dulu that the three were arrested by officers from his unit and released after spending four days in custody.

After their release, he said, he did not follow their movement and did not know their whereabouts.

Mr Kamwende had been summoned by Mr Justice Dulu to explain the whereabouts of Mr Burhan Adam Abdalla, an Eritrean, Mr Abdikadir Mohammed and Mr Ismail Noor Hassan. Also in court were Mr Kamwende's colleagues Alfred Majimbo and Simon Murage.

The suspects, Mr Kamwende said, were freed on July 29 at 7.30am.

Mr Justice Dulu's summons arose out of an application filed by a lobby group on behalf of the three.

Muslims for Human Rights moved to court on July 31 seeking orders to have Mr Abdalla and two others produced in court or for the police to explain why they are holding them.

The lobby also sought orders requiring the police to take to court any warrant that allowed them to arrest the men or authorised their detention.

The group complains that Mr Abdalla has been held for more than 24 hours without being charged in a court, contrary to the law. He was arrested on July 27.

Three suspects

Yesterday Mr Kamwende, who has served as the head of the anti-terrorism police unit for the last three years, told the court that the three suspects were arrested at Kenyatta National Hospital and Sagret Apartments in Nairobi.

The suspects, he said, were arrested because of certain allegations made against them.

He, however, did not specify the allegations and who made them.

According to Mr Kamwende the police were unable to charge the three in court because they could not verify the allegations against them.
