The lawyer of Hussein Radjabu, Prosper Niyoyankana, has a cause to be happy after the case of his client was transferred from the Supreme Court to the Court of Appeal. This transfer was done two weeks ago but to date this case has no yet got its number which would speed up the public hearings. Niyoyankana denounces the lack of neutrality that characterizes the Burundian Judiciary system when dealing with this case.
Hussein Radjabu was former leader of the ruling party, CNDD-FDD until February 2007 when he was dismissed. He was arrested more than five months ago and imprisoned under charge of attempt to the national security. During the time he was the leader of the ruling party, two decision-making centres characterized the country and they also prompted the resignation of the former second Vice President of the Republic Ms Alice Nzomukunda who joined MP Mathias Basabose in exile after she noticed that cabinet ministers were no longer answerable to her but to Hussein Radjabu although he was not in the executive.
Major cases of economic embezzlement and extrajudicial killings dogged the Nkurunziza's government when Hussein Radjabu was acting as the leader of the ruling party. These cases include the attribution of market to rebuild the road Bujumbura-Rumonge to an incapable Rwandan company, the sale of the presidential jet, and the killing of a number of people in Muyinga on the allegations that they were FNL supporters.
Speeding the case of Hussein Radjabu might therefore put at risk members of the executive who participated in these cases.
