Nigeria: Attorney-General to Partner With NCMG On ADR

In a collaborative effort, the Negotiation and Management Conflict Group (NCMG) and National Judicial Institute brought together stakeholders in a summit on a theme, "Restorative Justice, Peace Building and Economic Development in Africa: The Role of ADR."
The well attended event held at the MUSON Centre, Lagos last Tuesday which was chaired by Honourable Justice Muhammadu Uwais GCON, former Chief Justice of Nigeria and Chairman of NCMG Board of Governors focused on Alternative Disputes Resolution (ADR) methods in the legal system and how it helps in the speedy resolution of conflicts in Nigeria.
In his opening remark, Hon. Justice T.A. Oyeyipo OFR, Administrator, National Judicial Institute commended the NCMG for its approach to resolution of conflicts and observed that it is not only the government that should be saddled with the responsibility of conflict resolution; non-governmental organisations should also be involved.
Discussants at the summit which was officially declared opened by Mr. Kehinde Aina, Executive Director and Founder, NCMG gave examples of how restorative justice and ADR are practiced, how it brokers peace among the key players of a crime or a civil conflict and how it brings about economic development.
Janine P. Geske, a Professor of Law at Marquette University illustrated the process of restorative justice as a triangular one. "At the top of the triangle is the victim and at the two other ends are the community and the offenders. If the three parties are brought forward in the healing process of restorative justice to listen to each other and work towards actively and creatively solving their conflict, they have moved from ADR to Complementary Dispute Resolution and the results have really been amazing," she said.
In his keynote address, the Attorney-General of the Federation and Minister of Justice, Mr. Michael Aondokaa, SAN who was represented by Mr. Simon Igede noted that the judicial system has a role to play in proffering solutions to the inefficiencies of the traditional court systems and promised to partner and sponsor the NCMG summit in 2008.
Other discussants drawn from Nigeria, Africa and the UK included, Hon. Justice Gunmi, Chief Judge of the Federal High Court Abuja, Justice Alaba Ajileye of Kogi State High Court, Dr. (Mrs.) Uju Agomoh, Director Prison Rehabilitation and Welfare Action (PRAWA) and Marian Liebmann.
The various discussants from Nigeria agreed that there had always been the existence of ADR in the Nigerian traditional societies.
"The people sit together in circles at the village square to mediate between the parties to a crime, all parties are involved in the dialogue process a healing process is undergone and the conflict is resolved. In modern term this process is referred to as Restorative Justice."
Justice Gunmi observed that restorative and transmutative justice also exist in Africa but goes beyond restitution; the offender has to apologise to the community.

Another important issue also discussed at the summit was "The Promise of Early Case Assessment and Dispute Systems Design in the Effective Management of Corporate and Commercial Disputes in Africa." The discussants at these session agreed that conflict usually arose when host communities to these huge finance projects felt that their environment was being degraded. They proffered that these disputes or conflicts should be solved using ADR methods otherwise the host communities if they felt cheated will result to jungle justice like what is happening in the Niger Delta where the militants have taken laws into their hands.
