Nigeria: MTN, Celtel Lose Round One to NCC

Lagos — Justice Dan Abutu of the Lagos Federal High Court, has vacated an ex parte order that had protected MTN Nigeria Communications Limited and Celtel Nigeria Limited from a directive forcing them to compensate customers, because of their poor quality services.

A statement made available to THISDAY disclosed that Justice Abutu yesterday quashed the interim order against Nigerian Communications Commission (NCC), after hearing its application and submission. NCC had argued that the ex parte order had subsisted for 34 days, as at Monday, November 19, 2007, in contravention of the 14 days' period provided for in Order 9 Rule 12 of the Federal High Court. The court, therefore, vacated the order.
