AN ENVIRONMENTAL activist has laid a criminal charge against Khabisi Mosunkutu, Gauteng MEC for agriculture, conservation and the environment, for allegedly contravening the Water Act.

Nicole Barlow, of the Environment and Conservation Association, accuses Mosunkutu and some of his officials of ignoring advice from experts in his department against certain property developments. This follows the Democratic Alliance's (DA's) request to Gauteng Premier Mbhazima Shilowa to institute a commission of i nquiry into the matter.

"These are serious charges. If the MEC were convicted he could face a fine of up to R1m or time in jail," DA provincial MP Hendrika Kruger said.

Shilowa's spokesman, Simon Zwane, said the premier was studying the allegations." He has asked the MEC to provide him with a response on the claims contained in the DA report."

Zwane said Mosunkutu was expected to respond by the end of next week. "The premier will then decide on the best way to handle the matter after studying both reports from the DA and from the MEC," he said.

The DA wanted an inquiry into allegations about at least eight developments, including the Blair Atholl golf estate on Gary Player's land.
