ODM has blamed PNU on the delay in the formation of a new Cabinet.

The party threatened to resort to mass action if PNU dishonours the power-sharing deal between President Kibaki and Prime Minister-designate Raila Odinga.

Party Secretary-General, Prof Anyang' Nyong'o, said the delay in naming the new Cabinet indicated that PNU was not 'serious' on the agreement.

"The US Secretary of State (Ms Condoleezza Rice) was clear last month that the sharing of power must be real," said Nyong'o.

He accused President Kibaki and his associates of deliberately frustrating the formation of the coalition government by proposing to form "a nonsensically bloated Government".

"It is unbelievable for the kind of ministries the PNU side has proposed. We (ODM) demand that the number of ministries be 34," he said.

On Tuesday, President Kibaki and Raila failed to agree on the size and portfolio balance, raising anxiety on the new Cabinet line-up.

The Standard obtained documents indicating a proposal by PNU for a Cabinet of 44 ministries. Some of the new ministries include Nairobi Metropolitan Development and Implementation of Vision 2030.

Nyong'o termed the proposed ministries "a big joke", which Kibaki wants to use to reward his cronies.

Speaking at Esivalu Primary School in his Kisumu Rural Constituency, Nyong'o said ODM had intended to have only 24 ministries if they had formed government.

He, at the same time, said major reforms in the Civil Service were long overdue. He said the current structure of the Civil Service was prone to abuse.

"Some civil servants have discretionary powers and this affects service delivery," he said.

He cited Head of Public Service and Secretary to the Cabinet, Mr Francis Muthaura, as one of those with such powers.

"He (Muthaura) takes part in politics as there is no clear law hindering him and others from doing so," said Nyong'o.

Recently, Muthaura tried to 'clarify' the power-sharing deal, and said it did not include sharing positions in the Civil Service.
