THE High Court has ordered the commissioner for Labour to mediate and resolve a dispute between former workers of the defunct Uganda Electricity Board (UEB) and the Uganda Electricity and Allied Workers Union.

The 1,117 workers are demanding retirement benefits from the union, saying they made contributions to it, while still employed by the company.

Their lawyer, Peter Kimmanje-Nsibambi, told court that the union had breached a contract between the two parties by failing to pay the workers their benefits.

The union constitution, Nsibambi argued, made it clear that benefits, to be determined by the executive, would be paid upon retirement or death.

He said by being retrenched between 1998 and 2001, the former employees could be equated to retirees.

UEB was disbanded in 2001 and was replaced by the Uganda Electricity Generation Company, the Uganda Electricity Transmission Company, the Uganda Electricity Distribution Company and the statutory board.

However, E. Habakurana, the union lawyer, said the former employees were still members of the union and deserved no benefits.

In his ruling, Justice John Patrick Tabaro ordered the labour commissioner to ensure that arbitration should be completed within 30 days from March 7.

The judge also directed the commissioner to establish whether the former employees were entitled to their benefits under their union constitution and, if so, how much.
