Village Chief Magistrate Lot Moroka has ordered former Debswana managing director, Louis Nchindo and his co-accused, Garvas Nchindo, Joe Matome and Jacob Sesinyi to inform the Directorate on Corruption and Economic Crime (DCEC) whenever they plan to leave the country.

The three are facing up to 36 corruption related charges. On Friday, the defence and the prosecution reached a gentleman's agreement on the dates to file responding papers over the disputed involvement of the legal firm Collins, Newman and Company in the case. This came following a notice of motion urging the court to order Nchindo's instructing lawyers, Collins Newman Attorneys, to withdraw from the criminal case.

Advocate Peter Hordes for the defence confirmed before Moroka that they will file their responding papers on April 30. The Directorate of Public Prosecutions (DPP) has promised to file a response on May 16. Moroka has set June 6 for the hearing of the dispute over the involvement of the law firm in the case.

A partner at the firm, Jeffery Bookbinder is set to lead the defence team in arguing whether or not they should remain on the case.

The prosecution stated it had added four additional charges to the charge sheet. But state counsel, Mathogonolo Phuthego, said the two parties had agreed the charges would not be read out to the accused until the prosecution has corrected the charge sheet. In the new charges, Nchindo is accused of making a false statement while under oath and two counts of cheating of public revenue against. Together with Matome, he faces an additional count of stealing by servant.
