Botswana: Man Appears for Defiling Girl

A Briton aged 68 appeared briefly before Extension Two magistrate facing two counts of defiling persons under the age of 16 .
Senior Magistrate, Mrs Dumisile Dlamini-Ngandu, heard that the accused, Phillip Tempest, defiled two Tlokweng young girls aged below 16 on diverse dates between February and March 2008. The accused was not asked to plea.
Tempest, who was also refused bail, will appear for another mention on April 14 when the issue of bail will be addressed.
Refusing Tempest bail application, Magistrate Dlamini-Ngandu, said investigators should be given enough time to finish their investigations without anybody tempering with their duties.
She also said children who are involved in the case could easily be manipulated and hence the issue of bail was still not acceptable.
This was after Tempest asked the court to grant him bail as he had lived in Botswana for almost 20 years. He said he had some properties at Sir Seretse Khama Airport and a house in Gaborone.
He also suggested that he could also surrender his passport or any travelling document to the state and also report to any police station, as the court would direct.
He said denying him bail would also prevent him from looking for a lawyer of his own choice.
Earlier on, the Prosecutor, S/Insp. Mogobye asked the court to remand the accused so that there could be a free flow of investigations.
He said if the accused was admitted to bail, he might temper with potential state witnesses. S/Insp. Mogobye said the offence of defilement was serious and that the accused might opt to flee to his country. Meanwhile, a case in which Chedza Mogae is charged with drunken driving failed to resume at the Extension Two on Monday to make a ruling on whether she has a case to answer or not. The Prosecutor, Mr Bafi Nlanda, said in an interview Mogaes lawyer, Mr Lawrence Khupe, indicated last week that she would not be able to attend to court because of other unforeseen circumstances.
