Magistrate Kayode Olagubutu of the Banjul Magistrates' Court has, on Thursday, 10 April, cautioned the state counsel in the trial of Superintendent Manlafi Sanyang that he would have no option but to strike out the case if the counsel fails to appear before him by the next sitting date. The magistrate's warning came as a result of the failure of the state counsel, Emmanuel O. Fagbenle to appear in court on several occasions.

Defence Counsel Lamin S. Camara said that he will not urge the court to go for an adjournment or a stand down but instead for the court to discharge the accused, Manlafi Sanyang.. Camara said that it is against the fundamental rights of the accused person for not having a speedy trial. Camara added that the accused has been granted bail and has met the conditions but he is still in detention.

"I therefore urge the court to discharge him for lack of diligent prosecution".

Inspector Touray, who was holding brief for Fabgenle, told the court that Mr. Fagbenle is a busy man who might be appearing at the High Court. But Magistrate Kayode dismissed Touray's excuses, noting that there are many lawyers at the Attorney General's Chambers who can come to court to represent him.

Kayode stressed that he would adjourn the matter for the last time; that if the prosecution fails to appear, he will strike out the case.
