Francistown — Thirty-five-year-old Balakidzi Thwai Billy had his hopes of walking free shattered on Wednesday as the office of the Directorate of Public Prosecution (DPP) failed to send a representative for the hearing of his case.
Billy is faced with a charge of threat to kill in which he is accused of threatening his wife, Dananani Grace Nthati, by saying, "If I come to Moroka I will leave two corpses."
Billy, who was at that time working in Tutume, had heard rumours that his wife, who works in Moroka, was cheating on him and thus called her on her cellphone to warn her. He then proceeded to go to Moroka but was there confronted by the police before he could get to his wife.
Dananani has since decided to forgive her husband and withdraw the case. But the magistrate court could not act on the matter in the absence of the DPP. The prosecuting officer then requested that the accused be granted bail while waiting to appear before court for the withdrawal of his case. Billy was granted bail to the amount of P500. He was also warned against having any interaction with the complainant until his next court appearance, which is on the 28th April 2008.
