Namibia: Katima Rape Trial Off After Suspect's Death

The High Court trial of a Caprivi Region resident accused of raping a Dutch visitor to Namibia almost three years ago will no longer take place.
The rape charge that had been pending against Simon Mukata Visco since late May 2005 was withdrawn by State advocate Dominic Lisulo in the High Court in Windhoek on Monday last week, when Visco was supposed to make another pre-trial court appearance.
Visco was not in the dock before Acting Judge Hosea Angula, though. The reason was that he had died, Lisulo informed the Acting Judge. Visco died at Katima Mulilo on February 28 this year. He was 24 years old. On his death certificate, tuberculosis is stated as the cause of death. Visco's trial was scheduled to take place between mid-April and May 14.
The complainant in the case against Visco was 26 years old at the time of the alleged incident. She was visiting Visco at his home at Katima Mulilo late on the evening of May 19 2005, it is alleged in the indictment that Visco was set to face at his trial. They later left Visco's house to go to someone from whom Visco claimed to want to fetch money for repairs he had done to this person's car, it was alleged. That person was not there, though, so they proceeded on their way to a bakery at the town.
While on the way, Visco told the complainant that he wanted to have sexual intercourse with her, it was charged. She told him that she could not do that, and that she did not love him, it was alleged. Visco's reaction to this was to grab the woman, which caused her to fall to the ground, it was charged.

He then overpowered her and, despite efforts from the woman to stop him, he raped her, it was alleged. Visco was free on bail pending his trial.
