JOHANNES Fredrick Fick, the Beatrice farmer who was convicted of breaching the Land Acquisition and (Consequential) Act by refusing to vacate Victory Farm, has been ordered to leave the farm within 45 days.

Harare magistrate Miss Catherine Chimanda also imposed a wholly suspended prison term of six months on Fick on condition he is not convicted of a land-related offence within the next five years.

Miss Chimanda said the sentence would go a long way in deterring would-be offenders.

Immediately after the sentence, defence lawyers Makombe and Associates filed an appeal at the High Court challenging the sentence. It was submitted that the sentence imposed was not in conformity with the provisions of the Act in question. The sentence, the lawyers argued, should be set aside and Fick should be sentenced under the proper section.

Prosecutor Mr Tawanda Zvekare established that in 2006, Fick was ordered to vacate Victory Farm by December 20 after his farm had been compulsorily acquired by the State for resettlement.

However, the Minister of Lands issued Fick with an authority of temporary extension of stay, which allowed him to wind up his businesses by September 30 last year. But Fick illegally continued to stay at the farm even after the lapse of the grace period.
