Uganda: Disabled Sue Centenary Bank in Gulu

THE Gulu Disabled Cooperative Group has taken Centenary Bank to court for allegedly failing to give them easy access to the bank premises.

One of the aggrieved, Santo Dwoka, told court that the group members have difficulty moving on the steps leading to the banking hall.

During the hearing of the civil suit at Gulu High Court on Thursday, the lawyer for the disabled, Lloyd Ocorodiya, demanded general damages and the costs of the case.

But the resident judge, Remmy Kasule, said damages could only be awarded to the complainants if they had incurred physical injuries on their bodies due to difficulties in climbing the steps to access the bank.

"You did not suffer any damage in climbing the bank stairs, where is the basis for awarding you general damages?"he asked.

The judge added that the bank said they had already modified the steps on the doorway for the disabled and elderly people.

Robert Mawanda, who represented Centenary Bank, told the court that they could not accept liability because the required structural changes had been made.

He explained that the financial institution had delayed in completing the work because they had to get the consent of the landlord and the municipal council.

The bank building is on the Gulu-Kitgum road.

However, Justice Kasule ordered the bank to pay the costs of the suit of the complainants.

He urged the lawyer of the disabled people to compile the costs and any other expenses they could have incurred in the case and forward them to the respondent.
