The Federal Government yesterday asked an Abuja Federal High Court to dismiss the suit instituted by Chief Gani Fawehinmi against the appointment of Mrs Farida Waziri as the new chairman of the Economic and Financial Crimes Commission (EFCC).

Chief Fawehinmi, the Lagos based lawyer and human rights activist is challenging the constitutionality of the appointment of Mrs Waziri saying the procedure for the removal of the former boss as provided for by the EFCC Act was not followed.

Gani maintained that the position which Mrs Waziri is occupying is not vacant because the removal of Mallam Nuhu Ribadu, according to him was illegal because Ribadu was yet to complete his tenure as the EFCC Chairman.

But the government through the Attorney General of the Federation (AGF) and Minister of Justice, Chief Michael Kaase Aondoakaa also claimed that it did not re-appoint Ribadu for a second term in office as EFCC chairman.
