Three people charged together with businessman Chris Kirubi have finally appeared in court.

The three, who were said to be out of the country when the rest took plea, denied the charges of defrauding Uchumi Supermarkets on Wednesday. Nigel Ralph, Amin Akbekali and Shamash Habib were given Sh400,000 cash bail.

The charge sheet indicates that Mr Kirubi and 13 others are said to have conspired to defraud Uchumi Supermarkets by selling a piece of land on which the supermarket's Aga Khan Walk branch stands for Sh147 million.

It is alleged that they sold the land to a company called Allgate and then leased it back to the supermarket at a monthly rent of Sh1.7 million. The offence is said to have been committed between March 27, 2003, and November 30, 2004. The case will be heard on July 7.

Lawful custody

Elsewhere, a man was yesterday charged in a Kerugoya court with escaping from lawful custody. The charge against Mr Martin Chomba, 25, stated that last June, 30, he escaped from Kerugoya GK prison where he was serving a one-year jail term for breaking and stealing.

Mr Chomba denied the charge and the magistrate ordered that he be taken back to prison until July, 22 when the case will be heard.
