Nairobi — A missing court file Monday caused police to delay responding to allegations that officers assaulted activists who were demonstrating against the controversial sale of the Grand Regency Hotel.
The file is said to have been misplaced at the registry, leading a Kibera court to adjourn the case until next Monday.
Defence lawyer Harun Ndubi told the court that police used excessive force to break up the gathering, resulting in one of the activists, Mr Okiya Omtatah Okoiti, sustaining a back injury.
Other activists, Ms Ann Njogu, Sheikh Ahmed Ramadhan, Mr Ouma Odera, Mr Fredrick Odhiambo, Mr George Nyongesa and Mr Habel Okundi had earlier been granted a Sh10,000 cash bail each.
On Monday, the magistrate extended the Sh10,000 cash bail for Mr Okoiti.
In another case, a court was told that a man who was shot by a motorist died because his brain could not control his heart.
Dr Dan Gikonyo, who attended to the man before he died told a Nairobi court that he suffered serious brain injury.
He said Mr Benjamin Edward Rahedi stayed in hospital for almost two months before he died. He was giving evidence in a case in which Mr Albert Kubai Mbogori is accused of murdering Mr Rahedi on January 26. The case continues.
A United States International University (USIU) student narrated to court yesterday how she was shot and injured in the hand by policemen seven years ago.
Ms Nicole Caroline Njeri, who was 14 years old at the time, was giving evidence in a case in which constable Jackton Ben Lekushula is charged with wounding her on December 31, 2001 at Elf Petrol Station, now Total Petrol station on Ngong road.
The hearing continues.
In another case, former MP Alfred Nderitu is demanding Sh12 million from Mwea Rice Growers Multi-Purpose Society in Mwea constituency.
Mr Nderitu told court that he gave money to the society when it was in trouble, but that it was yet to pay him.
But the society has denied the claims, saying Mr Nderitu made deductions of his money from the sale of the rice. The farmers are instead demanding Sh11,843,614 from their former MP.
The case continues Wednesday.
