Kenya: ECK Can Not Dictate Civic Nominees, Says Scholar

Nairobi — There is no legal requirement under the Local Government Act for the Electoral Commission of Kenya to ascertain the persons to be nominated as councillors by political parties, a law scholar has said.

Prof Githu Muigai said that after looking at the Constitution, the Local Government Act and recent decisions of the courts on the interpretation of the relevant provisions, the Local Government minister is not obliged to nominate councillors from a list received from the ECK.
