Nigeria: Group Moves to Retain Water Pumping Equipment in Okpella

A suit to prevent the Ministers of Agriculture, Environment, the Edo State Commissioner of Police, their agents, servants or privies from removing water pipes, water pumping machines, valves and other equipment from Okpella Community in Edo State has been instituted at the Federal High in Benin by Okpella Forum.

The Forum also wants the court to grant an order of interlocutory injunction restraining the Ministers, the Edo State Police Commissioners, their agents, servants or privies from removing the water equipment from the community pending the determination of the substantive suit.

In the suit filed by the Okpella Forum on behalf of themselves, Okpella Community and the Edo State Government, they explained that the water equipments were meant for the execution of water projects in Okpella by the Edo State Government.

The Forum, represented by Mr. John Okodo Esq. (President), Isa Afegbua Esq. (General Secretary), Godwin Umoru (Public Relations Officer) and Akure Abdumalik Afegbua, instituted the suit when they discovered that unknown persons who claim to be agents of the aforementioned persons tried to remove the water equipments from Okpella Community without authorization.

In its supporting affidavits, the plaintiffs averred that sometime in the month of October 2007, they noticed the 5th, 6th, 7th, 8th and 9th Defendants were trying to remove from Okpella town all the huge capacity water pumping machines, huge water pipes, huge vales and other implements meant and brought to the Okpella Community of Edo State for their water project.

The plaintiffs who prevented them from removing, stealing or carrying away from Okpella town all the water equipments then accosted them.

Following this development, the plaintiffs said that they were surprised when the 5th, 6th, 7th, 8th Defendants later showed up in Okpella town brandishing two letters dated 29th November 2007 titled, "Letter of Introduction", addressed to the 3rd Defendant and another dated 28th January 2008 titled, "Re sale of scrap and abandoned items", addressed to the Honourable Minister Federal Ministry of Agriculture as the power and authority by which they should remove from Okpella town all the water equipments.
