Ghana: Baby-Twins in Police Cells

A human rights activist based in Tema, is appealing to the Chief Justice, Mrs. Georgina Wood, to intervene and save a set of twins from the harsh conditions of police cells.
In a statement copied to Public Agenda, Mr. Camillus Maalneriba-Tia Sakzeesi said the crime of the twins is that their mother, Miss Lamisi Baba was one of several suspects arrested by the Tema Police in a dawn swoop at Community One on July 12.
According to the activist, the police was that magnanimous by granting bail to the mother due to the predicament of the babies, only for a judge to remand her when she appeared in court as requested by the police. She is to reappear on Monday July 28, 2008.
"The twins, who are a year and half old and their mother have since remained in the custody of the Tema Community One District Police Command, despite the hostile weather and several mosquitoes", the activist said. Enquiries Public Agenda made at the Police Station on Wednesday revealed that, the twins had been taken ill probably due to mosquito bites and improper feeding.
Mr. Maalneriba-Tia Sakzeesi, said the action of the Tema Circuit Court 'A' frowns on the fundamental rights of the innocent twins. "The most regrettable aspect of it all is that, the judge in the case is a lady who, saw the suspect strap the infants on her back when she was called to the dock", Mr. Maalneriba-Tia Sakzeesi pointed out.
The activist, quoted Chapter Five of the Constitution on "Children's Rights" which falls on Section 28, sub- section 3 and reads, "A child shall not be subjected to torture or other cruel, inhuman or degrading treatment or punishment", and wondered whether it is not the direct opposite of the twin's ordeal.
"The twin-babies, ashould not be made to suffer unduly due to an alleged felony that was committed by their adult mother", he said.
He stressed that the fact that the police granted her bail and she honoured the police demand for her to appear in court on that day, should have been used as ample assurance that should she be granted bail, she would do her best to attend court.
"The bench must be seen to be handling judicial affairs in strict but humane manner", he concluded.
