A Federal High Court sitting in Lagos yesterday directed that the international passport of the embattled former Ekiti State Governor, Mr. Ayodele Fayose should be released to enable him travel abroad for medical treatment.

Mr. Justice Tijjani Abubakar handed down the order while ruling on an application brought by the former governor praying the court for a stay of proceedings and an order directing the release of the passport.

The 47 year-old former governor of Ekiti State, Ayodele Fayose who was impeached on 16th October 2006, is currently standing trial for allegedly mismanaging over N1.4 billion belonging to the people of Ekiti State through the Ekiti State integrated poultry project.

The accused former governor, arguing through his lawyer, Ahmed Tafa, told the court to stay further proceedings in the case and to release his international passport on the grounds that only a living person can stand trial.

The first prayer seeking a stay of proceedings was opposed by Wahaab Shittu, counsel to the EFCC and was subsequently withdrawn and struck-out by the court.

However, the second prayer seeking the release of the passport was not opposed by the EFCC counsel who only told the court to ensure that the accused former governor was available for his trial.

The medical report attached to the ex-governor's application states that the illness for which he had been diagnosed could not be treated in Nigeria.
