Cameroon: Court Decision not Definite, Says Lawyer

The Bamboutos lawyer says this is because Fecafoot has appealed against the decision.

The saga between Fecafoot and Bamboutos Mbouda over corruption charges is far from over. According to the lawyer for the Mbouda club, Nkouendjin Yotnda, the Cameroon Football Federation had the right to appeal the decision which they did and it is only after the appeal must have been heard that the club can take a decision. "The court decision is not definite", he said "and it is only when the court must have passed its final judgement that the club can take a stand", he added.

It would be recalled that Bamboutos was found guilty by the disciplinary and homologation committee of Fecafoot of corruption during the match pitting them against Federal of Noun in Douala on September 16, 2007 and relegated to division III. The Fecafoot Appeal Commission that was solicited by Bamboutos to reverse the decision, failed to do so and Bamboutos therefore decided to take the matter to the law courts in October 2007. After several postponements, the Mfoundi court of first instance passed a judgement freeing Bamboutos of the corruption charges and asking Fecafoot to pay a symbolic one-franc fine in compensation to Bamboutos. A decision that was celebrated in pomp and pageantry in Mbouda as the people expected the cancellation of the Fecafoot decision and a return of their darling team to the MTN Elite One championship.

But according to the lawyer for Bamboutos, the decision has in turn been appealed by the Cameroon Football Federation. To the head of the judicial commission at Fecafoot, Patrick Ebodé Tsanga, disputes in sports are not solved in law courts according to the charter governing sports and physical activities in Cameroon. He said Fecafoot in the first place did not recognise the jurisdiction of the court to hear the case stating that even the court judgement did not say Bamboutos should be reinstated in division one.
