The Lusaka High Court has discharged Patriotic Front (PF) secretary-general, Edward Mumbi's ex-parte injunction restraining the Food Reserve Agency (FRA) from extending the marketing season and increasing maize prices.
Lusaka High Court Judge, Thomas Ndhlovu, discharged the injunction yesterday after hearing FRA's counsel and reading FRA executive director, Anthony Mwanaumo's affidavit.
Mr Justice Ndhlovu said that it appeared that Mr Mumbi had not furnished the court with all the information at the time of the ex-parte application for the interim injunction on September 25, 2008.
"This court orders that the interim injunction granted on the September 25, 2008 be and is hereby discharged," the judge said.
Following the discharge of the injunction, Dr Mwanaumo said in a statement later in Lusaka that all the buying points which had been closed were now operational and would continue to receive the commodity up to October 31 this year as initially scheduled.
He assured that farmers who delivered their maize from September 17 would continue to be paid the K55, 000 per bag.
"In this regard, our provincial staff and warehouse managers have been informed accordingly," he said.
He reiterated that FRA would continue paying for maize within the one-week time-frame, as money was available.
"Farmers are once again urged to bring their maize to FRA to be purchased before the onset of rain," he said.
