Kenya: Cockar Raps Nation's Knuckles

3 October 2008

Nairobi — The Cockar Commission on Friday admonished the Daily Nation for publishing a story highlighting a statement submitted to the inquiry by former Finance minister Amos Kimunya.

Chairman Abdul Majid Cockar said the story, published on Wednesday, was in contempt of the commission and had also sparked a massive debate.

Betrayal

In the statement, given to the commission in July, Mr Kimunya accused his colleagues and Prime Minister Raila Odinga of betrayal by not coming to his defence in the sale of the Grand Regency Hotel.

Mr Justice Cockar made the remarks following complaints by a lawyer for Westmont Holdings, Mr Harrison Kinyanjui, that Mr Kimunya had been given coverage in the paper yet he had opted not to give the evidence to the commission.

The lawyer suggested Mr Kimunya had personally talked to the press.

But Mr Kimunya's lawyer, Prof Githu Muigai, said it was clear in the story that the writer was quoting a statement obtained from the commission.

Mr Justice Cockar, a retired judge, also reproved his commission's staff for releasing the statement.
