Botswana: Man Sues for Castration of Bull

A man is seeking P39,000 in compensation because his bull was castrated unlawfully.Thapelo Mokoko says that his cattle-post neighbour, Maswabi Motswaledi castrated his bull without his knowledge and hence he must pay for it.
Giving evidence before Village Chief Magistrate Lot Moroka, Mokoko pointed out that he wanted to be compensated about P14,000 for the bull and P25,000 for damages.
He told the court that he arrived at P14,000 because of the characteristics of the bull.
"The bull had drought resistant qualities, it had qualities of producing dairy hybrid and its colour was suitable for the kind of cattle I want to breed," Mokoko said. He asserted that the castration of the bull denied his cows a chance to mate and conceive.
He pointed out that at the time the bull was castrated, he had about 25 cows, which were ready to mate.
Mokoko said it will only be fair if he is compensated P1,000 for each of the cows because the calves that they would have given birth to would have cost P1,000 each. Keorapetse Tsotane, the former herdsman for Motswaledi (the defendant) told the court that he tried to reason with his former employer not to castrate the bull but he would not listen.
Tsotane said the bull was always with Motswaledi's cattle. He told the court that he was dismissed after telling Mokoko that Motswaledi is the one responsible for castrating the bull. At the close of the case, the defence attorney, Opeyemi Ajeyi applied for dismissal of the case on the basis that Mokoko failed to show the connection between him and the bull.
Ajeyi said that Mokoko did not produce the bull's brand certificate in court to prove that he is the owner.
However, Mokoko's attorney, Mabala Rabashwa dismissed Ajeyi's submissions saying that his client has told the court that he can bring the certificate to court if asked to do so.
"It is only that he is not in possession of the brand certificate right now," Rabashwa said.
The case has been adjourned to October 15 when Moroka will make a ruling on the application for dismissal of the charge.
