Nigeria: ANPP Members Drag Ume-Ezeoke to Court

Abuja — Twelve aggrieved members of All Nigeria Peoples Party(ANPP) have gone to the Federal High Court in Abuja challenging the continued stay in office of Chief Edwin Ume Ezeoke, Senator Saidu Kumo and Prince Ebutta Ayyuk as members of the National Executive Committee of the party.

In Suit No. FHC/ABJ/CS/619/08 filed on their behalf by Ibrahim Isyaku (SAN) on November 4, 2008, the ANPP, Chief Edwin Ume Ezeoke, Senator Saidu Kumo, Prince Ebutta Ayyuk and INEC were named as defendant/respondents while Alhaji Suleman Argungu and eleven others were plaintiffs/applicants.

The plaintiffs are seeking a declaration that preceding the 2007 presidential elections, Chief Edwin Ume Ezeoke, having accepted nomination as a vice-presidential candidate by General Buhari is deemed to have resigned as National Chairman of the ANPP in compliance with provisions of Article 23.8 of the party constitution.

They also want the court to declare that having resigned by operation of the law, Chief Ezeoke cannot legally continue to preside over the affairs of the party in that capacity and also that all meetings either of NEC or NWC presided by Chief Ezeoke as National Chairman, including decisions reached since his nomination as vice-presidential candidate are null, void and of no legal effect.

The plaintiffs further sought a declaration that under section 26 (iv) of the ANPP constitution, the duo of Senator Saidu Kumo and Prince Ebutta Ayyuk, National Secretary and Deputy National Chairman (South) respectively are estopped from performing functions of those offices having accepted appointment as Special Advisers to Mr President.

Among the 23 reliefs sought by the plaintiffs is also an order of perpetual injunction restraining Chief Ezeoke from summoning, attending and presiding over any meeting of NEC, NWC or BOT in his capacity as National Chairman.
