A BENIN High Court has fixed January 19, 2009, as date for hearing on the substantive suit filed by the faction of the Peoples Democratic Party (PDP) in Edo State led by former Governor Oserhiemen Osunbor/ Dr Samuel Ogbemudia against the appointment of Chief Samson Ekhabafe as Chairman of the party in the state by the National leadership of the party.
The court had earlier granted an interlocutory injunction restraining the National Chairman of the PDP, Prince Vincent Ogbulafor or anybody acting under their authorities, from removing the Edward Sado-led state Executive Committee of the party pending the determination of the suit.
But arguing that the party had the right to settle any internal dispute, Chief Ekhabafe asked the court to vacate the injunction restraining him from parading as Chairman of the party in the state.
But his request was rejected by the court, after it argued that it has the right to hear the matter since Sado emerged through a congress and his name was already forwarded to the national leadership as the chairman of the party.
Chief Ekhabafe is backed by the faction of the party led by the former Chairman of the Board of Trustees (BOT) of the PDP, Chief Tony Anenih, while Sado is backed by former Governor Osunbor and Dr Ogbemudia led faction.
However, according to the Enrolment of Order Motion on Notice made available to Vanguard, the suit which is being presided over by Justice Cromwell Idahosa, will be given accelerated hearing.
