Nigeria: Court Dismisses MTN's Objection to Suit

Justice Saliu Saidu of the Federal High Court in Osogbo, Osun state capital, has dismissed an objection raised by MTN Nigeria Limited in respect of the suit filed by the national chairman of Committee for Democracy and Rights of the People (CDRP), Amitolu Shittu.

The suit, filed on behalf of residents of Osogbo, is challenging the poor telecommunication services being rendered by MTN to its subscribers in the town and environs.

Joined as respondents to the suit are MTN Nigeria Limited and the Nigerian Communications Commission (NCC) as second defendants.

MTN had through its counsel, U.G Akpanuko, maintained that the court was not the appropriate jurisdiction to entertain the case.

Akpanuko had also urged the court to transfer the matter to another jurisdiction on the ground that the headquarters of both respondents are outside the jurisdiction of the court.

Replying, the plaintiff's counsel, Wilson Atirene, argued that since MTN had been providing telecommunication services to the people of Osogbo, the company could be sued in the town.
