Nigeria: Prison Official Sues NDLEA for Unlawful Detention

An official of the Nigerian Prison Service (NPS), Richard McCarthy has sued the Chairman of the National Drug Law Enforcement Agency (NDLEA), Ahmadu Giade, at a Federal High Court in Lagos, over alleged unlawful detention since February 19, 2008.

McCarthy, who filed the application under the fundamental human rights, maintained that he was abducted, arrested and detained since last year by the NDLEA without court order.

The applicant averred that the action of the NDLEA constitute an infringement on his fundamental human rights as protected by section 35 of the 1999 Constitution.

According to the suit now before Justice Binta Muritala Nyako, the applicant argued that the development was illegal and unconstitutional, as it violated his right to personal liberty and human dignity.

He said despite keeping him perpetually in custody, the NDLEA has also failed to file any criminal charge against him.
