Governor Theodore Orji of the PPA, had, in the appeal, challenged the Abia governorship election tribunal judgment, which declared Chief Onyema Ugochukwu of the PDP as the validly elected governor of the state.
The appellate court had reserved judgement indefinitely in the appeal. The Justice Abdullahi Yusuf-led tribunal had nullified Orji's election on the grounds that he did not resign from public service before vying for the governorship and that he belonged to the Okija Secret Society.
