Gambia: State Closes Case in D1.6 Million NIA Trial

The State on Monday, 6 July, 2009, closed its case in the trial of Demba Sowe and Babucarr Jallow, with the testimony of Sukuta Jammeh, prosecution witness number ten.

Appearing before Magistrate Kumba Sillah Camara of Bundung Magistrates' Court, Mr. Jammeh said he knew both accused persons as well as Christopher Badgie, whom he met on several occasions. He told the court that he headed a panel set-up by the then NIA director, Benedict Jammeh, to investigate an amount of money allegedly missing at the residence of Christopher Badgie.

According to Jammeh, both accused persons were invited to shed light on certain issues before the panel. Jammeh further told court that the panelists submitted a report to the then NIA director Jammeh.

When asked by State counsel, Bakum, whether the two accused persons had written any statement, he replied in the positive.

At this stage, the State counsel asked PW 10 whether he could recognize the report and to which he responded in the positive.

After the witness confirmed the document as said the report, the state counsel applied to tender it as an exhibit. Subsequently, the document was admitted and marked as an exhibit, without objection from defence counsel Lamin Camara.

Asked about the NIA procedure with regards to searching a house, Jammeh said at the end of the search, all the items in the house are listed and both the house owner and the officer in charge would sign before departure to the NIA office. This, he said applies when the person involved should be taken to the NIA office.

He explained that should there be a need for a watch man to be stationed at the house, one of their security should be placed there.

In his cross examination, defence counsel Camara asked PW10 whether it is correct that exhibit B was prepared by the second accused person to which he replied, he presumed.

Lawyer Camara also asked PW10 whether exhibit C is a detailed report with respect to the investigation and PW10 replied in the positive.

Meanwhile, the case was adjourned to Monday 13 July 2009 for the defence counsel to file a 'No case submission'.
