Kenya: Woman's Bid for a Slice of Former MP's Estate Fails

Nairobi — The High Court has dismissed a case in which a woman was claiming a share of former MP Kihika Kimani's estate.

The woman claimed she had been the former Molo MP's eighth wife at the time of his death.

Mr Justice David Maraga, sitting in Nakuru, ruled on that Ms Grace Wanjiru Kihika failed to prove that a marriage existed under Kikuyu customary law.

The judge, in his Wednesday ruling, said she had contradicted herself in giving different sums paid as bride price.

She had told the court that Mr Kimani wooed her when she went to his home in Lanet, Nakuru in 2000 in search of a job.

She said he went to her home with four of his wives and declared his intentions to marry her to her parents.

He did not take some elders with him as demanded by custom because at 70, he did not wish a younger person to speak on his behalf, she said.

She said Mr Kimani had paid her father Sh30,000 that day, but the father told the court he had been paid Sh20,000.

In April 2001, the former MP returned to her home with his wives and paid Sh120,000, she testified.

Ms Wanjiru said Mr Kimani introduced her as his wife at a rally and produced a copy of Taifa Leo with a picture of the event. She said Mr Kimani gave her a piece of land and she lived with him for two-and-a-half years.
