Botswana: Khama's Sexuality Discussed in Court

16 October 2009

Gaborone — President Ian Khama's sexuality will be discussed in a case at the Village Magistrates Court.

On Monday a non-citizen of Botswana, Sayed Fakhan Abbs Shah, was arraigned before the Gaborone Regional Magistrate, Lot Moroka, after Shah allegedly uttered words to the effect that President Ian Khama is of a different sexual orientation than the conventional.Shah is charged with use of insulting language to the President contrary to Section 93 (1) of the Penal Code.

According to the particulars of the offence, on October 6 at Jamal Trading Company in Gaborone, Shah allegedly uttered the words: "I do not f**k ladies just like your President Khama who does not have a wife."

The prosecution says this constitutes an insult to President Khama. The accused was arraigned on Monday where public prosecutor M. Seabonyana requested that the charge sheet be read to the accused and that no pleas be taken until the matter was referred to the Directorate of Public Prosecutions (DPP).

The prosecutor said the accused could be granted bail on condition that he surrenders his travel documents, would not interfere with witnesses and reports to the police.

Defence attorney, Duma Boko, said it would be difficult for the accused to comply with the condition not to interfere with witnesses when he does not know who the witnesses are.

The court granted bail on condition that the accused reports to the police every Wednesday, surrenders his travel documents and does not leave Gaborone without informing the police.

The case is scheduled for mention on October 28.

The courts of Botswana seem willing to engage in frivolous and idle cases. Is it that nothing happens in Botswana? Then just be happy and try not to embarrass the nation with frivolity.
