Zambia: High Court Denies Kapoko Bail

THE Lusaka High Court has dismissed a bail application by former Ministry of Health human resources officer Henry Kapoko because it lacks merit.

Kapoko had made an application seeking review of the order of revocation of bail by the magistrate court because there was possibility that the accused would interfere with witnesses.

Kapoko, through his lawyers, Nicolars Chanda and Kelvin Bwalya had also applied for an order that his earlier appeal applications to be determined by this court be treated as those coming for review and not as an application for an order of suspension of court and as appeals.

The lawyers also contend that appeal numbers 24 and 25 were lodged by error pursuant to section 332(1) and that they were applying that the same be treated as having been lodged under section 337 and 338 of the Criminal Procedure Code (CPC) and that the same be heard under its inherent supervisory.
