Gambia: Defence Expresses Concern Over the Sixteen 'terrorists'

Banjul — Defence Counsel, Lawyer Lamin Camara has express serious concern over the continued detention of the alleged 16 terrorists without taking their plea.

Lawyer LS Camara made this revelation on Tuesday October 20, 2009 before the special criminal court in Banjul, presided over by Justice Moses Richards on the ongoing trial of 16 accused persons arraigned before the said court on a criminal charge of prohibition of terrorism contrary to section 3 (I) of the anti-terrorism act 2002.

The 16 are: Alasana Thomas Jarjue, Maulud Badjie, Lasana Proper Sambou, Ousman Jarjue, Mansour Jatta, Sedat Jatta, Dawda Jatta, Fabia Jafuneh, Abdoulie Jatta, Samsideen Jammeh, Mumiru Bah, Kebba Secka, Kemo Konteh, Sam Kambai, and Abdoulie Jarjue. The accused are alleged to have jointly conducted, or engaged themselves in an unlawful act on August 8, 2006 at Darsilameh village in Kombo Central District of Western Region and in diverse places, in an unlawful act which may seriously destabilise or destroy the fundamental, political, constitutional, economic and social structure of The Gambia.

Lawyer Camara told the court that what he has is a charge sheet. Lawyer Camara saidthe state has still not complied with the order of the court to file all the necessary processes in the matter. Lawyer Camara said the accused has not taking their plea, noting that the court cannot proceed and the accused persons are taking to court on a daily basis when the proper processes has not been filed before the court.

Presiding Judge, Justice Moses Richards disclosed that since the accused persons have all secured the services of a legal counsel the court would not condone any foot dragging anymore and therefore ordered that the state file all the necessary processes before the next adjourned date failure to do so, may result to the court hearing the defence application for the accused persons bail. The matter was adjourned to October 29, 2009.
