Nigeria: Appeal to God, Supreme Court Tells Omehia

Abuja — The Supreme Court yesterday dismissed prayers made by sacked governor of Rivers State, Mr. Celestine Omehia, asking it to set aside its judgment which removed him from office and declared Rotimi Amaechi as governor of the state.

In a unanimous decision, five Justices of the apex court led by justice Aloysius Katsina-Alu asked Omehia to appeal to God if he cares because even if stays before them till December, he will never convince them to reverse their decision.

Justice Katisna-Alu described Omehia's action as a serious professional misconduct, just as he said, "we have given a decision two years ago and you are here asking us to review it. Even if we stay here till December you will get nothing.

"At best, you can attract punitive damage. Whether right or wrong, that judgment stands. You are treading a dangerous ground. We have no right to seat on appeal over our decision. Our judgment is not a nullity; you will go on to appeal to God".

Omehia's counsel, J.C Ezike, however remained adamant when he argued "The final decision is yours but the lesson of history is different. With regard to equity, none of Amaechi's claims is equitable. The court departed in that judgment. The issues brought before you were muted and you amended Section 22 (1).

Corroborating Justice Katsina-Alu's position, Justice George Oguntade asked Ezike to think twice saying "you should reflect over what you are doing not to us as a persons but the Supreme Court. What we have done was the best way we can safeguard our democracy."

But Ezike interjected again. This infuriated Justice Katsina-Alu who threatened to use police to take the lawyer out adding, "One thing I know is that God is not your client".

In a motion dated October 16, 2009, Omehia had asked the court to set aside its judgment which removed him from office and declared Amaechi as the Governor of the state.

On October 25, 2007, the Supreme Court annulled Omehia's election ruling that Amaechi, not Omehia was Peoples Democratic Party's (PDP's) legitimate candidate. Barely two years later, Omehia came back to the court seeking a judicial review of the judgment.

But Amaechi's counsel, Prince Lateef Fagbemi (SAN) urged the court to dismiss the application saying it is an abuse of court process.

Ezike contended yesterday that the apex court overshot its boundary on the grounds that it lacked the jurisdiction and competence to make the order.

He argued that in the said judgment "the court was wrong; it has no jurisdiction. If you find our application meritorious, you will have to set aside the judgment.
