Gambia: D 1.6 Million NIA Case Resumes

The trial involving the state and Demba Sowe and Babucarr Jallow, on Friday, 30th October 2009, resumed before Magistrate Kayode Olajubuti of Bundung Magistrates' Court.

In his testimony, the second accused Babucarr Jallow told the court that two vehicles were involved in the arrest of Christopher Badjie and that PW1 Sheriff Wadda was driving the first vehicle whilst he (Jallow) was driving his own vehicle.

He said when Christopher Badjie's arrest was about to be affected, he instructed his subordinates that they should drive straight to Badjie's compound and that he should not be allowed to communicate through a telephone.

According to Jallow, who is defence witness number two (DW2), Badjie at the time was in possession of two phones and that it was he (Jallow) who switched off both phones. After switching off the two phones in question, DW2 said he gave them to PW1 Sheriff Wadda.

He said that after giving the phones to Wadda, he realised that Wadda flouted his instruction by allowing Christopher Badjie to make calls.

At the time of the arrest of Badjie, Mr. Jallow said, they found the house opened and five people were also found there.

DW2 Jallow said he was partially disoriented because he felt he was misinformed by PW1 Wadda.

Asked by defence counsel Lamin Camara in whose presence was the search of Badjie's house conducted, DW2 said it was done in Wadda's presence. DW2 further testified by saying that it is not true that Wadda drew his attention to a sum of money which, he said, he saw while the search on Badjie's house was taking place.

DW Jallow also said that he, Wadda and Mamud Ceesay had conducted the search on Badjie's house and that this was done in the presence of one Gibril Badjie, a relative of Christopher Badjie.

He added that after the search an inventory was taken by one of his subordinates, Mamud Ceesay. After the inventory was taken, DW2 said it was signed by Christopher Badjie. He also testified by refuting allegations that he received an amount of fifty one thousand dalasi from Mariama Sarjo Jallow, wife of Christopher Badjie.

Mr. Jallow the court that when they went through the bank book of Mariama Sarjo Jallow, PW4, it was realised that Christopher Badjie was transferring money to her account at Trust Bank.

He said that having realised this, he informed his director who told him to recover the money from the said lady's account. He said he told Wadda to withdraw the amount and which he did and that the money in question was handed over to the then NIA director of finance, Mr. Bakary Gassama.

DW2 further refuted allegations that the concealed vital information saying all the information gathered during the investigation of Christopher Badjie, was handed over to the office of Director of Public Prosecutions. He told court that he did not either destroy any evidence while carrying out an investigation against Badjie.

DW2 described it as in correct that the assertion by PW10 Sukuta Badjie that there is an NIA directive demanding an operative to post somebody at a place after a search when there is no watchman.

Jallow said he served NIA for fifteen years and that PW10 was his junior but there is no such directive as said by Jammeh.

He added that Badjie's photograph was taken while he was opening the save. DW2 also stated that he is aware that Badjie was charged before the Banjul Magistrates' court and that he is currently standing trial at the High Court. He told the court that it was the search which he spearheaded against Badjie which had led to charges against him (Badjie).

He further said that the investigation against Badjie has revealed that he was in possession of multiple national documents. He told court that a request was made to the United States Embassy in Banjul with a view to establishing Badjie's trial identify.

He said the U.S Embassy responded by saying that Christopher Badjie had over twenty two names and was linked with a number of alleged crimes committed across America.

He said it was also made clear that there was an arrest warrant for Christopher Badjie for alleged crimes in the United States.

At this stage, the case was adjourned to 3rd and 6th November 2009 for cross examination of DW2 by state counsel S.H Bakum and for another defence witness to testify, respectively.
