Kenya:Judge Rejects British Lord's Plea in Property-Sharing Case

Nairobi — A British Lord has lost a case in which he was suing his former wife over the sharing of millions of shillings of their matrimonial property.

Lord Melvin Blackburn had sued Lady Kathleen Blackburn with whom he separated three years ago, claiming an equal share of the property they had jointly invested in before their separation.

But Malindi judge Hellen Omondi ruled that Lord Melvin will get only a percentage of the money and property he had acquired by virtue of his name having been registered in the ownership documents.

The judge also ruled that Lady Kathleen had obtained most of the properties before she was married to him.

As a result, those properties could not be equally shared between them.

Lord Melvin sued his wife in 2007 after the two separated. He wanted the money they invested in their joint names in life insurance policy numbers EDZ 2001059/1 to EDZ 20059/ 12 at the AXA Isle of Man in Britain be split for each to get an equal share. In the ruling, he got between Sh6 and Sh7million which is 10 per cent of the €20,000 they had invested.

He further claimed half the value of the house built on LR No. 1705/233/63 and LR No. 1705/233/85 in Kilifi Bofa which was their matrimonial home.

But the judge gave him 20 per cent of the value which is equivalent to about Sh4 million to Sh5 million.Lady Kathleen had refused to recognise Lord Melvin's entitlement to the property. She stated that she met him in abar and he was broke at the time.
