Nigeria: Illegal Possession of Firearms - Court Dismisses Case

Yenagoa — A Federal High Court sitting in Yenagoa, Bayelsa State capital, Tuesday, struck out a case of illegal possession of firearms instituted against Mr. Famous Daunemigha, former aide to the State governor, Chief Timipre Sylva.

The court action was sequel to the withdrawal of the charges levelled against the defendant by the prosecution counsel, Assistant Superintendent of Police (ASP) Henry Ogbeiwi.

Defending the withdrawal of the charges, prosecution counsel said the case has been taken over by the Force Headquarter, in Abuja.

Based on the submission of the prosecution counsel, Justice Olayinka Faji in his ruling, thereby, struck out the case.

Daily Champion recalls that the defendant, Mr. Famous Daunemigha was arraigned on June 10, 2009 at the Federal High Court for an alleged illegal possession of firearms, although he pleaded not guilty to the charges.

The charges sheet reads No: FHC/YNG/16C/2009 read thus: that you Famous Daunemigha on the 6th day of June, 2009 at No 42 Bay bridge road Kpansia within the jurisdiction of this Honourable had in your possession two pump Action guns reasonably suspected of having been stolen or unlawfully obtained thereby committed offence punishable under section 27(b) (i) of the Fire Arms Act CAP F.28 Laws of Federation of Nigeria 2004.
