A day-long workshop on the introduction of the High Court Amendment Rules 2009 to members of The Gambia Bar and judicial officials was yesterday held at the Kairaba Beach Hotel.
The amended rules are aimed at promoting the expeditions and efficient disposal of cases as well as delivery of efficient justice by the various courts within the country. The gathering was also aimed at familiarising all parties concerned with the content of the amended rules and the rationale behind its amendments.
The amendment is in exercise of the powers conferred on the Rules Committee under Section 55 of the Courts Act. Some of the amended rules included citations, filling and service of pleading, adoption of affidavits and adoption of documents as evidence among others.
The Chief Justice of The Gambia, Emmanuel Agim, in his remarks, cited the significance of expedition trial, noting that it ensures justice. He spelt out public concerned cases and acknowledged that public?s confidence in the judiciary should also be maintained.
While expressing concern over the prolonged cases, Chief Justice Agim said that it is high time that certain mechanisms are put in place to avoid unnecessary delay of cases especially civil cases.
Highlighting the rational behind this amendment, Chief Justice Agim indicated that the amendment will ensure amicable settlement of matters regarding civil suit cases and also to ensure substantial justice in other matters.
