Gambia: Defence Discards Alibi Issue in Banjul Murder Trial

Banjul — Lawyer S Jaharteh, the defence counsel for one Dawda Bah yesterday told the special criminal court, presided over by Justice Richards that the defence would not be able to call a witness who could attest to the alibi of her client in the murder case involving him.

The accused, Dawda Bah, is alleged to have caused the death of one Cherno Jallow (alias Cher boy) by stabbing him on the neck with a broken bottle on August 23, 2008 at Perseverance Street in Banjul. When the matter came up yesterday, S Jaharteh made an application to close the defenceÂ's case on the grounds that the defence was not able to get to the witness who could provide the alibi.

The defence had raised the issue of an alibi when the accused testified that on the day of the incident, he was in Wellingara with his sister watching TV and not in Banjul. The principal state counsel, W. Shanaka has made an application for the state to call witnesses to counter this allegation. The application was consequently granted and the matter has been adjourned to November 24, 2009 for the prosecution to call witnesses.
