Abuja — Justice Moses Richards of the special criminal court in Banjul yesterday, Monday 23, 2009, convicted and sentenced one Newton Nefe after he was found guilty of the criminal offence of attempted robbery, contrary to section 274 of the criminal code.
The particulars stated that on May 25, 2008 at Sukuta, the accused, a Nigerian, and another person called Mr West (now at large), attacked one Susan Baxter - a Briton, beat her up, injured her severely, and tied her up and were demanding for money, when they were interrupted by the arrival of the police and her neighbours. The two were said to have tried to escape, but only Mr West succeeded in scaling the fence, while the accused, Newton Nefe, was arrested inside the compound of the complainant.
Justice Moses Richards, in his judgement, disclosed that the prosecution had proven its case beyond all reasonable doubt and decried the rising level of violence. The DPP applied for compensation for the victim, Susan Baxter and in agreeing with the DPP, Justice Richards sentenced the accused to a fine of D25,000 in default to serve 5 years imprisonment and also ordered him to pay the sum of D50,000 as compensation to the victim in default to serve 10 years imprisonment. Both sentences are to run consecutively.
