The High Court will today decide whether or not to disband the current managers of Uganda Young Men's Christians Association (YMCA) over alleged mismanagement of the institute including financial fraud.
Justice Kibuuka Musoke is set to decide on the legal dispute brought by concerned members of the Association against the YMCA and its four managers, a matter that has been in Court since 2002.
The members who filed the case through Sebalu & Lule Advocates include Canon J. Bikangaga, Mr E. Sempebwa, Mr Godfrey Mukasa and Mr Sammy Senkumba.
They sued the Registered Trustees of YMCA, the chairperson of its executive committee, Mr James Nkata, the treasurer, Mr Dan Nkwata, the Secretary General, Mr Robert Jjumba and Mr Clement Ndyashankaki, the national president of the association.
Unconstitutional leading
The plaintiffs sued the trustees accusing them of mismanaging the administration and financial affairs of YMCA.
They want an order directing the defendants to account for monetary transactions of the association as well as surrender the accounts of YMCA including funds donated by donors, a permanent injunction restraining the defendants from contravening the association's constitution and its objectives plus costs.
The plaintiffs claim YMCA was registered as a trust body in 1963 with the Minister of Mineral and Water Resources.
However in 1997, the defendants and others attempted to amend the association's constitution and filed it with the NGO board.
According to the plaintiffs, the defendants used the amended constitution to conduct elections which the plaintiffs dispute because the amendment was done without the knowledge of all members of the association.
The defendants have denied the claim, saying none of them was appointed in office unconstitutionally.
